This past weekend, Panama proudly celebrated its profound cultural richness at the 45th National Handicrafts Fair 2025. From intricate woven baskets to elaborate molas, and from unique ceramic pieces to finely crafted jewelry, the exhibition highlighted the incredible talent and dedication of Panamanian artisans. This year's fair also featured live demonstrations of traditional crafting techniques, interactive workshops for children, and a stage presenting a continuous program of folk music and dance, further enriching the cultural experience for all attendees.

The First Lady of the Republic, Maricel Cohen de Mulino, accompanied the esteemed Minister of Culture, Maruja Herrera, at the official opening of this important annual event. The fair, a vibrant showcase of Panamanian artistry and tradition, drew thousands of visitors eager to experience the country's diverse creative heritage. The event underscored the government's commitment to supporting and promoting the "Orange Economy," recognizing the significant contribution of the cultural and creative industries to the nation's economic growth and social development.rtant fair, where both officials cut the ribbon and toured the various craft pavilions.

Panama, a nation globally renowned for its strategic canal, is rapidly emerging as a vibrant hub for the Orange Economy, also known as the “Creative Economy”. This dynamic sector, encompassing everything from arts, culture, design, and music to audiovisual production, software development, and digital content creation, offers an abundance of opportunities for both local and foreign stakeholders.

As a boutique law firm in Panama, we are delighted to shed light on the compelling reasons why individuals and businesses in the creative industries should consider Panama’s opportunities for this sector, focusing on legal compliance, local benefits, and financing avenues.

Understanding the Orange Economy: Why Panama is a Creative Hub

The 'Orange Economy' is about the economic value that comes from intellectual property, creativity, and cultural expression. It's a strong force for creating jobs, driving new ideas, and supporting development that lasts.

Panama is perfectly placed to benefit from and contribute to this worldwide trend. Our country's unique location, improving digital setup, and growing creative community make it ideal. Panama shows its dedication to supporting the creative sector through its government plans. A main goal is to build a legal system that helps this sector. This means looking into tax benefits and other ways to help, making it easier to import materials for creative work, and strongly protecting intellectual property rights.

Panama already has several important laws that support these industries, showing a long-standing commitment to culture and creativity:

  • Law 13 of 1976: Recognizes the right to take part in cultural life, approving the International Covenant on Economic, Social and Cultural Rights.

  • Law 14 of 1982: Focuses on protecting and preserving National Historical Heritage, strengthening INAC's role.

  • Law 11 of 1988: Provides protection for composers and performers, encouraging national music festivals.

  • Law 27 of 1997: Promotes the protection, development, and commercialization of the artisanal sector.

  • Law 20 of 2000: Addresses Indigenous collective intellectual property rights.

  • Law 16 of 2012: Establishes a special regime for cinematographic and audiovisual industries.

  • Law 64 of 2012: On Copyright and Related Rights, recognizing creators' rights across various artistic, literary, and scientific works.

  • Law 80 of 2012: Provides incentives for tourism, integrating cultural tourism as a national priority.

These existing frameworks highlight Panama's foundational support for a diverse range of creative endeavors.

Panama's Legislative Drive: Paving the Way for the Orange Economy, and What's Still Needed

The Panamanian government has shown strong leadership in boosting the Creative Economy. It became a pioneer by enacting Law 424 or 2024, a significant step promoted by the Ministry of Culture and the National Assembly. This law aims to develop the creative economy and its educational and cultural parts as a key sector for Panama's cultural, social, and economic growth. Its goals include strengthening the creative economy ecosystem, promoting cultural education, and supporting entrepreneurship within cultural and creative industries (ICCs), even for local communities.

This piece of legislation was introduced, focusing on helping our cultural and creative industries truly shine. This law aims to create regulations, taxes, and rules that make it easier for national companies to grow and compete, encourage variety, and generally make these sectors stronger. It also supports the idea of creative districts – special zones where cultural and creative businesses can easily set up and thrive.

Furthermore, Law 424 seeks to improve the legal, regulatory, and administrative framework for national creative companies and identifies new incentives to attract foreign investment in cultural and creative industries, facilitating access to local markets, technology transfer, innovation, and job creation. It outlines actions for development, including tax incentives, competitive funds, training, easier import/export processes, migration facilitation, and other strategic incentives.

However, the absence of crucial regulatory frameworks to implement Law 424, particularly for this key legislation, is currently holding back the nation's progress. At a time when development is urgently needed, this gap in regulations is hindering growth and preventing important social and economic advancements. The delay in establishing and enforcing these essential guidelines means that the potential benefits of the law are not yet being fully realized, leading to stagnation in important sectors.

Why Panama is Ideal for Creative Professionals and Businesses

For creative professionals, entrepreneurs, and investors, Panama offers a compelling blend of advantages:

  • Strategic Location: Panama's role as a regional hub helps with international collaborations and market access, especially within Latin America and the Caribbean.

  • Growing Digital Landscape: With increasing demand for IT/tech-related jobs, including designers and digital content creators, Panama is investing in its digital infrastructure, creating a fertile ground for tech-driven creative ventures.

  • Cost-Effectiveness: Compared to many developed nations, the cost of living and doing business in Panama can be significantly lower, allowing creative endeavors to flourish with potentially reduced overheads.

  • Welcoming Expat Community: Panama boasts a diverse and active expat community, providing a supportive network for those looking to relocate and integrate.

  • US Dollar Economy: The use of the US dollar as its official currency provides stability and simplifies financial transactions for international stakeholders.

Navigating Legal Compliance and Protecting Your Creations

For a creator, Panama offers a vibrant ecosystem with a growing appreciation for artistic and cultural endeavors. The continuous increase in public spending on culture, with INAC's budget alone increasing by over 104% from 2010 to 2019, shows a clear commitment. The nation's diverse cultural heritage, with its rich history, folklore, and gastronomy, also provides a unique source of inspiration and a distinct market advantage.

As with any business venture, understanding the legal landscape is crucial. For creative professionals and businesses, particular attention should be paid to:

  • Intellectual Property Protection: Your creative works are your most valuable assets. Panama, as a signatory to the Berne Convention, offers automatic copyright protection from the moment a work is created and fixed in a tangible medium. However,  we highly recommend registering your copyrights with the General Directorate of Copyright (DIGEDA) under the Ministry of Commerce and Industries. This provides official proof of ownership, which is crucial for enforcing your rights in legal disputes and claiming damages in cases of infringement. Our firm also assists with trademark registration and other intellectual property safeguards.

  • Company Formation: Foreigners looking to establish a presence in Panama often find that full company formation is the most common and advantageous route. Our firm can guide you through the incorporation process, ensuring your business complies with Panamanian commercial law and optimizes potential tax and legal benefits.

  • Work Permits and Residency: For foreigners considering relocation, Panama offers several attractive visa options. The  "Friendly Nations Visa" is particularly noteworthy, allowing citizens from specific countries to apply for fast-track permanent residency by demonstrating professional or economic activity in Panama and proving economic solvency. Our firm provides comprehensive advice and assistance with work permits and residency applications, ensuring a smooth transition.

  • Tax Compliance: Panama operates a territorial tax system, meaning income generated outside of Panama is generally not subject to Panamanian income tax. However, it's crucial to understand the implications for local operations. Our tax law specialists can help you optimize your tax burden and ensure compliance with all national tax obligations.

Unlocking Incentives and Financing Opportunities

ree

Panama is actively working to foster the growth of its creative industries through various incentives and initiatives. While the comprehensive legal framework for the Orange Economy is still evolving, some key areas offer significant advantages:

  • Film and Audiovisual Industry Incentives: Panama has a notable Film Law (Act 16-2012) that provides attractive incentives, including a 25% cash refund for foreign film and television projects that meet specific criteria (minimum budget of USD $500,000 to USD $40M spent in Panama). This also includes tax-free temporary importation of film equipment. Our firm can assist production companies in navigating these incentives and ensuring eligibility.

  • Strategic Zones: Consider establishing your creative enterprise within special economic zones like the City of Knowledge or Panama Pacifico. These zones offer state-of-the-art infrastructure and can provide certain tax exemptions and operational advantages for businesses focused on technology and innovation, which often intersect with the creative economy. The City of Knowledge, for example, has actively supported the creative and cultural sectors through initiatives like the "Trama" program and the Creative Industries Cluster.

  • Emerging Funding Landscape: While traditional financing for creative industries might be nascent, the growing recognition of the Orange Economy's potential is attracting more attention. The World Bank, for instance, is engaged in initiatives to strengthen Creative and Cultural Industries in the region. We can help you explore potential avenues for project-based financing, government grants, and connect you with relevant local and international organizations that support creative endeavors. Furthermore, the increasing presence of tech and IT sectors in Panama suggests a potential for venture capital and angel investment for innovative creative startups, particularly in areas like digital content, gaming, and creative technology.
